Not so fast! While news broke that Erika Jayne seemingly had a big win in court over the weekend, she shouldn’t celebrate just yet. One of the largest cases filed against Tom Girardi also included his now estranged wife, Erika. The lawsuit was being handled by class action firm Edelson PC. The firm is representing the victims of the Lion airplane crash, from which Tom allegedly misappropriated their settlement funds. Tom also stands accused of using said funds to upkeep his lavish lifestyle with the Real Housewives of Beverly Hills star. All while the victims have received very little or nothing at all.
Erika has long been trying to get the suit against her dismissed. Which it just was, according to court documents. The docs read, “Pursuant to stipulation, plaintiff’s claims against defendants EJ Global LLC and Erika Girardiare dismissed without prejudice and without costs.” Both parties “mutually agreed” that Erika’s “dismissal is appropriate.” But according to Jay Edelson, who is handling the case, there’s good reason for that.
As reported by Radar Online, Jay said the case was only dismissed to “avoid fights over jurisdiction.” It will now be refiled against Tom and Erika in the state of California, where they both reside. The suit was previously filed in Chicago. Jay tweeted out,”The suit is being refiled in California (to avoid fights over jurisdiction). No chance we are letting @erikajayne off the hook, especially given the evidence we have found. All money will go fully to the victims until they are made whole.”

The Edelson law firm has repeatedly claimed they have proof that “money that belonged to the surviving widows and orphans of the victims of that plane crash had, in fact, been used to make payments for Erika or her companies.” And since Tom’s law firm, Girardi Keese, has since gone bankrupt, a judge ruled that Tom’s clients could go after Erika to collect their money.
Erika, who has been defiant in the press and on social media, took to Instagram to gloat over previous ruling. In her Instagram stories, she posted a gif of herself from a confessional where she’s dressed wearing a crown. The gif is captioned “F**k you!” while she laughs. Erika’s celebration is now short lived and I’m not holding my breath for her to post the update. But damn if it doesn’t feel good to see the carpet pulled out from under her.
