90 Day Fiance: Happily Ever After is premiering on Sunday. Why is this relevant in an article about Ashley Martson and Jay Smith’s marital status? Because plenty of 90 Day Fiance fans are calling Ashley’s latest divorce filing a conveniently timed publicity stunt.
But could it be legitimate this time? After all, this time the divorce petition is accompanied by cryptic Instagram posts, and a summons for Jay to appear in immigration court. It seems there may really be trouble in Mechanicsburg, PA.
Ashley dropped a few hints via her Instagram posts. On Wednesday, Ashley captioned a photo of herself filming for Happily Ever After. She wrote, “behind every strong woman lies a broken little girl who had to learn to get back up, fix the broken pieces, and never depend on anyone.”

Last week she alluded to Jay’s immigration issues saying, “it’s all fun and games until your ass gets deported. Have fun at the strip club with MY money and MY car you’re driving around without a license.”
Ashley admitted that she hadn’t applied for Jay’s Adjustment of Status during the 90 Day Fiance reunion. This petition, if approved, grants a two-year green card. As a result, Jay is currently without proper documentation. He is ordered to appear in immigration court on May 8th.

Ashley spoke to US Weekly following her divorce filing. She claims that the marriage was “real” and that she feels “devastated” by how it’s all played out. US Weekly chronicled the brief but eventful relationship in a recent article.
Fans of the show may not be surprised by the news, but the more important question for consumers is how it will play out on the new Happily Ever After season? Tune in April 28th for the premiere.
