Good news and bad news for Teen Mom star Amber Portwood as the Indiana Child Protective Services has now closed its investigation against her.
The bad news? Her baby daddy Gary Shirley was awarded primary physical custody of their 3-year-old daughter Leah. “Today amongst all days is the single greatest day for the rest of my life:)…My daughter officially mine. More than before. Love you so much @leah_leann so were hitting up some Disney in Florida to celebrate. :)” tweeted the classy Gary yesterday. And just in case you forgot, yes, Gary did open up a Twitter account for his 3-year-old.
Gary’s lawyer Jeff Lockwood also confirmed the news to Hollybaby. “Today the Department of Child Services dismissed their case against both parents,” Jeff stated Wednesday. “Now that DCS is out of way, regular court order comes into play.”

So what does this mean for Amber, 21? Jeff explains, “Gary is the primary custodian which means he has custody of Leah and Amber has visitation rights.”
Jeff adds that Leah will be with Amber every other weekend, Friday through Sunday, while alternating holidays and time in the summer with Gary.
While Amber admits Gary now has primary physical custody, she gives an interesting explanation to E! Online. “Gary and I have joint custody and Leah only lives with him because they [CPS] felt she wasn’t safe with me when my house got vandalized,” states Amber.
Amber also adds that Gary and her are doing much better as co-parents to Leah. “We’re getting along fine, not fighting,” she said. “Everything is finally good.”
The investigation by Child Services began last year after MTV aired footage of Amber physically attacking Gary in the presence of their daughter, Leah. In fact, Amber was arrested for domestic violence and ultimately received a suspended two-year sentence, plus two years of probation. Amber has had an especially hard time in the past year which included a suicide attempt back in June followed by a 2-month stint in rehab.
